Jaffer Sadiq case: Madras HC issues notice to Delhi prison chief

The petitioner submitted that he was released on bail from the NDPS act case prior to the execution of prisoner in transit(PT) warrant, hence his detention after granted with bail is illegal, he submitted.

CHENNAI: The Madras High Court issued notice to the Director General of Prisons, Delhi and Tihar jail authority in the plea of alleged drug kingpin Jaffer Sadiq, challenging the remand order issued by the lower court in the money laundering case.

A division bench of Justice SM Subramaniam and Justice V Sivagnanam heard the plea of Jaffer seeking to set aside the remand order issued by the principal sessions court Chennai on July 15.

The petitioner submitted that he was released on bail from the NDPS act case prior to the execution of prisoner in transit(PT) warrant, hence his detention after granted with bail is illegal, he submitted.

Jaffer submitted that he was granted bail on July 10 but the Tihar central prison authority took him under custody while he was in bail and produced before the sessions court Chennai on July15, which is against law, he said.

Further the remand order issued against him by the sessions court in the prevention of money laundering act (PMLA) case registered by the Directorate of Enforcement (ED) is also illegal, he added.

After perusing the petition and hearing the petitioner the bench issued notice to the respondents returnable by 1 week for further proceedings.
