Pull up non-responsive CMDA and Corpn officials, HC tells govt

Coming down heavily on the Chennai Metropolitan Development Authority (CMDA) and the Greater Chennai Corporation for refusing to respond on representations received, the Madras High Court has directed the government to find out the reasons for such a non-responsive attitude and take suitable action against officials found guilty.

Directing the demolition of an unauthorised construction at Rutland Gate in Nungambakkam within six weeks, a division bench comprising Justice M Sathyanarayanan and Justice R Pongiappan, said: “This court has come across very many cases where the official respondents concerned, despite receiving representations, not even choose to respond, in spite of tall claims made by the government as to the availability of e-Seva portal and the public connect facilities.” 

Citing to the failure in adhering to the Administrative Reforms Committee recommendation that ‘every letter or petition received from the public in government office should be acknowledged within the stipulated period’, the bench led by Justice Sathyanarayanan said: “This court deprecates inaction on the part of the Member Secretary, CMDA and the Commissioner, Chennai Corporation, in not responding to the representations submitted in the form of a legal notice.” 

However, the bench, on finding prima facie materials to establish that an unauthorised construction in the form of the second floor to an extent of 412.80 sq.m has been made, directed the Corporation to cause an inspection of the premises in question and take immediate steps, in accordance with the law, and complete the said exercise within six weeks.
