The first bench comprising Justice Sanjay Kishan Kaul and Justice R Mahadevan on perusing the status report and on recording the counsel for the petitioner’s submission that despite a chargesheet being filed way back on June 30, 2014, the non-bailable warrants against the accused is still to be executed, said “There is merit in the contention of the petitioner that at the stage of investigation these accused would have been identified and details  obtained. Thus, the police plea that they are unable to arrest the accused is unacceptable. We thus call upon the police to take appropriate steps to arrest the accused.”

The bench also directed the Judicial Magistrate, Tindivanam, who has taken the case on file, to send a status report to the high Court on December 2, the next day of hearing.

However, on aspects pertaining to relief sought for, the bench held that “in so far as the larger claims are concerned the matter be looked into if those claimants are unable to produce the documents to substantiate higher amount of loss. This aspect also be looked in by the government.” The plea pertains to the attack on Dalits of Kattayan Theru colony by the PMK men and Vanniyar Sangam cadres.
