Firm restrained from using trademark of oil company

The Madras High Court on allowing a plea moved by Kalleesuwari Refinery Private Limited bearing its trademark ‘Gold Winner’ has restrained Lakshmi Traders in Dindigul from using the word ‘winner’ in their products.

Justice S Vaidyanathan on noting that as the balance of convenience lies in the favor of Gold Winner, this court is of the view that the copyright of the applicant’s brand should be safeguarded said, “Hence, there shall be an order of interim injunction as prayed for, in both the application for a period of four weeks.” On allowing private notice, the judge posted the matter to March 12 for further hearing. The applicant had submitted that the artistic work used in their packing material used for packing refined edible sunflower oil and bearing its reputed trademark Gold Winner is being substituted by Lakshmi Traders with the word‘winner’ bearing the same trade dress, colour scheme and get up like Gold Winner.
