Andipatti MLA drops plan to retract petition

After generating much hype and triggering two contempt of court petitions, the disqualified legislator Thangathamizhselvan has backed off from his plan of filing a petition before the third judge to withdraw the petition against Speaker P Dhanapal’s disqualification order.

One of the 17 MLAs, who filed a case in the Supreme Court seeking change of the third judge, said Thangathamizhselvan had been persuaded by the other functionaries in the Amma Makkal Munnetra Kazhagam to wait for the verdict of the third judge since he had declared that the case would be taken up on a daily basis.

The other MLAs had assured him that they would not go in appeal if the third judge upholds the Speaker’s order and they could force elections to all the 18 constituencies creating a crisis for the Edappadi K Palaniswami government.

The camp led by TTV Dhinakaran hopes that the judgment will be delivered before the Independence Day, since the judge had demonstrated his urgency by announcing that the case would be heard for five days continuously.

However, if the disqualification is set aside, there will be a window of opportunity for the ruling party to move for an appeal in the Supreme Court and drag the case further. But, one of the MLAs P Vetrivel said, “Once the disqualification of the 18 MLAs is quashed, they will approach the Supreme Court to allow them function as legislators till the final verdict of the apex court is delivered.” If the Supreme Court accepted the plea of 18 MLAs and refused to grant a stay to the third judge order, they would regain their posts and enter the Assembly, he said. 

In such a scenario, the government’s survival will depend on getting a stay for the order quashing the disqualification.

Dhinakaran camp also cited the BJP government’s plans to go for simultaneous Parliament and Assembly elections and said the ruling party at the Centre would push for Assembly elections once the 18 Assembly seats fall vacant.

The plan of Dhinakaran’s camp is moving along that of the Centre and a full tenure for the AIADMK would be ruled out then, he asserted.
