Chief Justice AP Sahi and Justice Senthilkumar Ramamoorthy, on allowing the plea in this regard, was not in favour of the single judge modifying the scheme of administration in place for managing Pachaiyappa Trust and ruling that the president of the Trust shall not be elected from among members and instead appointed by the HC from time to time.
He had also held that only a retired HC judge would be eligible to be appointed as the president and such a person could hold office for a period of two years and would be eligible for reappointment for one more term.
However, the bench accepted the request by retired HC judge P Shanmugam to absolve him of the responsibility and directed the Official Assignee of the HC to administer the Trust until the single judge passes necessary orders within three months.
