HC imposes Rs 1L cost on litigant for ‘abusing process of court’

CHENNAI: The Madras High Court on Thursday dismissed a petition along with the cost of one lakh rupees for filing one petition after another since 1990 for the same relief.

“The petition is only to protect the illegal occupation of the petitioner. I deem that this petition is an abuse of process of the court, ” Justice R Subramanian held.

M Alli, the petitioner, challenged the notification issued by the Tamil Nadu Housing Board (TNHB) for the process of possession handing over 2.674 grounds of land to one VA Joy in 1990.

The petitioner also prayed for quashing the allotment order claiming that the land belonged to her grandmother Lakshmi Ammal.

The petitioner claimed that her grandmother executed a settlement deed for the land in favor of her.

However, the judge held that except before civil court, all the suits of Lakshmi Ammal before HC and SC got dismissed.

“In fact, the HC already confirmed that Joy is the successful bidder and 2.674 grounds of land under his possession is valid, ” the judge ruled and directed the petitioner to deposit the cost in favor of Adyar Cancer Institute within August 30.
