Chennai
Justice P T Asha before whom a plea seeking an order of interim injunction restraining A K Chitrapandian from representing himself as general secretary of TNSVA came up said, "From the correspondence that has been enclosed, it is seen that Chitrapandian has been addressing various clubs describing himself as the General Secretary of TNSVA, though he had been removed from the membership in the Annual General body meeting dated December 03, 2018."
"Though Chitrapandian has been appointed only for the purpose of conducting the 21st Youth National Volleyball Championship, by a letter dated May 07, 2019, it is seen that he has addressed the president and secretary of all the affiliated District Volleyball associations as General Secretary."
Justice Asha on holding that the order dated April 27, 2019 has not given him any of the above rights, said, "The applicant association, has shown prima facie case that there must be an order of interim injunction, restraining Chitrapandian from holding himself as General Secretary, TNSVA, either directly or indirectly pending disposal of the arbitrationproceedings."
However, Justice Asha on noting that though a committee has been appointed for conducting the 21st Youth National Volleyball Championship, the TNSVA is issuing communications with reference to that.
"It is made clear that with reference to this Championship, the Adhoc Committee shall not involve themselves in the conduct of the selection process in any manner except to the limited extent as directed under the earlier order, namely, by providing the necessary funds for meeting all the expenses," Justice Asha held while issuing notice to Chitrapandian returnable by June 11.
It may be noted that Justice R Suresh Kumar in his order on April 27 had appointed Justice D Hariparanthaman, a retired judge of the Madras High Court, as election officer to conduct election to elect the administering body for TNSVA for the next four years from 2019 to 2023.
He also constituted a four-member committee which included Chitrapandian for selection of players from Tamil Nadu for the 21st Youth National Volleyball Championship, scheduled to be held from June 2, 2019.
