    Disqualification proceedings against 3rd AIADMK MLA stayed

    The Supreme Court on Friday stayed disqualification proceedings against Kallakurichi AIADMK MLA A Prabhu who was served notices by the Tamil Nadu Assembly Speaker P Dhanapal in connection with a notice served under the anti-defection law, days after it gave similar relief to two other party legislators.

    A bench of Chief Justice Ranjan Gogoi and Justice Sanjiv Khanna issued the notice and posted the matter for further hearing on July 12.


    Legislator A Prabhu had earlier sought time to reply to the notice. “Earlier this week, I submitted a petition to the Speaker, when the seven-day notice period lapsed seeking clarification on whether the interim stay order granted by the SC was applicable to me, but there was no reply and so I moved the apex court,” Prabhu told DT Next.


    “Now with the Supreme Court on vacation and the by-poll results expected on May 23, the Speaker will have to wait for further orders,” said an AMMK advocate.


    On May 6, the top court had stayed disqualification proceedings against AIADMK MLAs V T Kalaiselvan and E Rathinasabapathy.


    The three MLAs have 18 seasoned lawyers, including Kapil Sibal and Abhishek Sanghvi, representing their case.
