“When commercial disputes cases come up for hearing, the welfare of the employees should also be taken under consideration,” he said while delivering his address at the National Conference on Commercial Disputes held at Tamil Nadu State Judicial Academy, Regional Centre.

At the same time, judges should also ensure that the no harm was done to the justice. They should also analyse the reasons for the delay and finish such cases fast, said Umesh Lalit.

The Chief Justice of Madras High Court Indira Banerjee said that the delay in commercial disputes would reflect on the economy. “When it takes four or five years to end the cases, foreign companies may hesitate to invest in the country,” she added.

“In countries like Germany, Australia, Pakistan, America, Singapore, Dubai and others, there are separate laws for commercial disputes. Especially in Dubai and Singapore, there are special courts for disputes arising out of commercial establishments,” she  mentioned.

“The government should also introduce a system, where advocates from foreign countries can argue in commercial dispute cases. If cases related to commercial disputes are heard by special courts, the cases can have a speedy trial. Also, the Judges and Lawyers should show special interests to complete the commercial disputes cases for the betterment of the nation,” said Chief Justice.
