A division bench comprising Justice M Sathayanarayanan and Justice R Hemalatha refused to grant further extension of the interim order after observing that near normalcy has returned in Tamil Nadu. Based on it, the bench closed the petition putting an end to further extension of the interim relief.

Noting that the courts and tribunals were not accessible due to the nationwide lockdown, which caused inconvenience to the litigants and lawyers alike, the High Court had on March 26 extended all interim orders subsisting as on March 20 to April 30. Thereafter, it had been periodically extending it, with the last extension ending on November 4.

Similarly, all orders of eviction, dispossession or demolition, which have not been executed till date on the orders of the High Court, District Courts or the Civil Courts, were also kept in abeyance.

However, it was clarified then that in case the extension of the interim orders causes undue hardship, the respective parties would be at liberty to seek appropriate relief as may be advised. In case of eviction, the interim orders could not be taken advantage to create any third party rights in respect of the land and superstructure, which may be the subject matter of either eviction or demolition.
