Unethical practices in accident claim settlement should be eradicated to protect the interest of the genuine victims, said the Madras High Court on Wednesday while directing the DGP to ensure that investigation by police in accident claims are completed and the documents as contemplated under the detailed accident report (DAR) are uploaded on the Crime and Criminal Tracking Network and Systems (CCTNS) website within 90 days from the date of accident.

Justice SM Subramaniam passed a slew of directions, while dismissing a tribunal order that had provided a compensation of Rs 1.07 lakh in an accident claim despite police deposition that the plea was based on mistaken facts and no such accident had happened. The registration number of a lorry that passed by the road was given after a delay.

The documents should be uploaded after verifying their authenticity with the concerned departments / insurance companies, Justice Subramaniam said, directing the DGP to ensure that the name, address, mobile phone number of the victim or of spouse/children were uploaded in the website clearly.

Aadhaar particulars of the victim/spouse/children should also to be uploaded to identify the claimants and avoid multiple claim proceedings, the judge said, and directed the DGP to send e-mail to specified ID of the respective Motor Accident Claims Tribunals and insurance companies in respect of the FIR and other documents uploaded by the police.

The judge also directed the Director of Medical and Rural Health Services to maintain accident registers, in a specific colour with continuous running numbers, at all government hospitals and upload accident particulars in the medical department official website within seven days.
