Realty firm told to refund booking amount

The District Consumer Disputes Redressal Forum, Chennai South has ordered a real estate firm to pay compensation of Rs 20,000 and refund the booking amount of Rs 50,000 to a customer who backed out of the project after learning that the said plot was unapproved and facing legal issues.

According to the complaint, K Subramani, a resident of Valasaravakkam, was contacted by a real estate firm named Manju Groups for selling small budget residential land in EMI basis. Subramani booked a plot in the firm’s upcoming project named Swarnadha Grand at Melakondaiyur in Kancheepuram and paid a sum of Rs 50,000 as an advance on June 20, 2016.


Subramani submitted that after the firm gave him a set of documents, he took a legal opinion of the plot. “After scrutinizing the documents, Subramani learned that the plot was unapproved and there are legal problems in the property. When he requested to refund the amount, the firm has not responded to his request,” the petitioner claimed.


Forum President M Mony and R Baskarkumaravel, Member, who presided over the bench, ordered the firm to repay the advance amount and to pay a compensation of Rs 10,000 for mental agony with the cost of Rs 10,000.
