    Student allowed to retake Class 11 exam

    Coming to the rescue of a student who had reportedly failed to score good marks in three subjects in her Class 11 science stream exams owing to ill health, the Madras High Court has directed the school to allow her to take the exams to enable her to pursue her Class 12 in science stream during the academic year 2018-2019.

    Justice S Vaidyanathan, on recording the submission that the petitioner will not insist on continuing in Padma Seshadri Bala Bhavan at K K Nagar, after clearing the three subjects in Class 11, said “Taking note of the said submissions of the counsel on either side and considering the facts and circumstances of the case, the minor petitioner is permitted to take up Class 11 examinations in the subjects, Physics, Chemistry and Mathematics in Padma Seshadri Bala Bhavan.”

    P. Sharon Nivedita had contended that she passed her Class 10 examination with 80% marks. She opted to study science in her Class 11 but from 2018 she has not been well. During the first week of March 2018, she had to be hospitalized and was diagnosed with juvenile diabetes, which caused severe mental trauma.

    But prior to her annual examinations, the school informed her parents that she had failed in physics the previous examination. Subsequently, on March 2018 she was informed that she had a choice to redo her Class 11 in commerce stream or take a transfer certificate (TC), which would mention that she was ‘detained’ in Class 11, and leave the school.

    Aggrieved by the school’s decision to not furnish her evaluated answer sheets and hold re-examination, Sharon moved the court.

    But the school’s counsel on conceding that even though the school has erred in permitting students who have failed in two subjects, to take up re-examination, said the petitioner will not have any right to appear in three subjects, as CBSE regulations does not permit a student to take up re-examination in three subjects.
