HC dismisses plea to transfer Kallakurichi teacher to other prison

CHENNAI: The Madras High Court on Wednesday dismissed a petition of an advocate filed for shifting a woman Maths teacher who was arrested in the suspicious death of a Kallakurichi schoolgirl case from Salem prison to other prison.

A division bench of Justice Paresh Upadhyay and Justice V Bhavani Subbaroyan dismissed the petition filed by advocate P Rathinam of Madurai on the ground that it is non-maintainable.

The judges dismissed the petition observing that they could not entertain the habeas corpus petition and the plea to compensate and release the innocents who were arrested in the school violence case cannot be heard by them.

The petitioner alleged that the woman teacher who was arrested in the case is facing threats from the secretary of school in the Salem prison. He noted that several innocent youths were arrested in connection with the Kaniyamoor school violence case. The petitioner wanted a direction to all the magistrates to issue a direction to provide legal assistance through the district legal services authority.

Recently, a division bench of Justice S Vaidyanathan and AD Jagadish Chandira dismissed the plea on the same ground of questioning the maintainability.
