Chennai: Justice AD Jagadish Chandira of Madras High Court on Monday quashed an election case pending before Karur district judicial magistrate booked against actor and AIADMK’s star campaigner R Ramarajan.

The charges were violating the Election Commission of India’s conduct code during his 2016 state assembly poll campaign. The petitioner submitted that the police has no jurisdiction to file the FIR under Section 188 of the CrPC and hence taking cognizance by the judicial magistrate-I is liable to be quashed.

“When taking cognizance of a case filed under Section 188 of the CrPC, evidence should be considered. However, the competent public servant had not furnished any evidence. The JM-I failed to consider that there is no evidence in the records to make out a prima facie case against him,” Ramarajan submitted.

On recording the submissions, the judge quashed the case filed against the actor.
