Case of bursting crackers on Deepavali: HC orders to give job to police aspirant
Coming to the rescue of a person who stood to lose his job in the constabulary force for a case booked against him for bursting crackers on Deepavali, the Madras High Court on seeking the Tamil Nadu Uniform Services Recruitment Board to abstain from acting in a mechanical manner directed it to provide appointment order to the person concerned.
Chennai
Justice V Bharathidasan before whom the plea moved by Balaji of Dharmapuri District seeking to consider his candidature came as he was not aware of the case booked against him, directed the Board to provide him with an appointment order within eight weeks.
As per the case, Balaji had participated in the recruitment held for the constabulary force in 2019 and had cleared both the written and physical test. However, when he was waiting for the appointment order, he was informed about the rejection of his candidature owing to a case pending against him at the Pappredipatti police for bursting crackers during the 2018 Deepavali.
Balaji contended that since it was a simple bailable case and sine he had no information about the same, he had not mentioned about it in the application.
The Government pleader contended that the rejection was for concealing such information and that the petitioner cannot say he was not aware of the same while the case is in progress at the local magistrate court.
But Justice Bharathidasan on setting aside the Government submission ruled in favour of the petitioner.
