HC says no to quash interim RS Bharathi bail

The Madras High Court on Saturday refused to quash the interim bail granted by a lower court to DMK organising secretary RS Bharathi in a case booked under the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act of 1989 and instead directed the lower court to consider his regular bail application on the day of surrender.

Justice M Nirmal Kumar was passing orders on a plea moved by Central Crime Branch (CCB), to cancel the interim bail. Elaborate arguments had prevailed with senior counsel R Shunmugasundaram appearing for Bharathi, that he had no intention to speak ill about any caste group much less the Scheduled Castes. The DMK’s organising secretary was booked for reportedly claiming that some from the Scheduled Castes became judges because of alms provided by M Karunanidhi.

State Public Prosecutor A Natarajan had submitted that the lower court had found prima facie case against Bharathi, when he was arrested and produced before the court on May 23 for remand to judicial custody. But the court while remanding till June 5, had on its own granted interim bail based on the threat perception owing to COVID-19, he said and sought to cancel the interim bail granted.

He further argued that the sessions court has gone beyond its powers to grant the interim bail when the accused person had not preferred any bail application.
