HC nod for CAA stir in Kumbakonam
Even as a division bench of the Madras High Court is seized over the conduct of anti-CAA protests across Tamil Nadu without due police permission, a judge of the Madurai Bench, while allowing a writ petition seeking to hold public meetings in support of the CAA, observed that India being a vibrant and functioning democracy ought to allow both to articulate their respective side.

Justice GR Swaminathan made this observation while setting aside the police order refusing permission to a public meeting in support of the CAA at Kumbakonam. The police had refused permission claiming that several Muslims are residing in the vicinity and that if any hate speech is made, it will give rise to serious lawand order issue.
However, on noting that the apprehension raised by Nachiyarkoil police cannot be casually brushed aside and that this court cannot be unmindful of what happened in Delhi recently, said, “What is sauce for the goose is sauce for the gander. It this court has been permitting anti-CAA meeting to be conducted, this court is bound to permit holding of meetings in support of the CAA. Also, the Citizenship Amendment Act is an Act that has been validly passed by the Indian Parliament. If a person wants to conduct a meeting in support of the same and if the said right is sought to be infringed, it is the duty of the police to provide the fullest protection for the same.”
Also, on pointing out that this court had consistently allowed more than a dozen writ petitions seeking to hold public meetings condemning the recent amendments made to the Citizenship Law, said, “No one can dispute that the issue raised by the petitioner is being debated at all levels at present. Writ petitions have been filed in the Supreme Court. Articles are being written both for and against. Leaders and intellectuals are taking positions.”
However, on recording the undertaking given by the petitioner to ally the concerns expressed by the police, the judge directed Nachiyarkoil police to make appropriate bandaboust arrangements for the peaceful conduct of the meeting without any interruption or interference.
“The authorities ought not to forget that Article 19 of the Constitution confers the right of freedom, speech and expression and the right to assemble peacefully without arms. These fundamental rights, of course, can be subjected to reasonable restrictions laid down in Article 19(2) and (3) of the Constitution but not more or beyond,” JusticeSwaminathanadded.
AMENDED ACT WILL AFFECT ALL SECTIONS, SAYS NEDUMARAN
The Citizenship Amendment Act (CAA) will not only affect the Muslims, but also all the sections of people belonging to the backward class, claimed Tamil National Front leader P Nedumaran here on Saturday.
Addressing the conference of the Progressive Women Advocates Association, Nedumaran said, it is the duty of the advocates to go into details of the CAA and educate the common man about its adverse impact.
“This not only affects the Muslim community but also the poor, marginalised and people from backward class,” he said.
Stating that the Sri Lankan Tamils are also Hindus, Nedumaran said, they are originally from India and why the Indian government maintains them as refugees.
“Can’t they provide citizenship to them?”, he asked. He said that cases are registered against those who protest against the CAA and also those who support the protesters. “As many as six cases are registered against me too,” he said.
The BJP-led Centre has been looking at the Muslims and the Tamils as their enemies and even the international forum had questioned it but they maintained an unusual silence, he said.
Stating that it is the duty of everyone to stop implementing the CAA in the country, Nedumaran said, as many as 13 states refused to implement the CAA and passed resolution in their respective Assemblies.
He claimed that the people have voted wrongly to the BJP and as a result, the charge NSA against those who talks against the government and focus them as anti-nationals.
He also said that the BJP has been planning to split the people based on their religion which is a serious threat to a secular nation like India.
