    Periyar rally talk: Order on plea for FIR against Rajini today

    The Second Metropolitan Magistrate Court, Egmore is to pronounce verdict on Tuesday in a plea moved by Dravidar Viduthalai Kazhagam to direct the state police to file an FIR against actor Rajinikanth for making fraudulent statements insulting the Dravidian ideologists and followers of Periyar in golden jubilee celebrations of Thuglak magazine on January 14, 2020.

    When the plea came up on Monday, S Arumugam, a practising advocate filed an intervening petition to made party to the case. He contended that the petitioner has filed the plea not in the interest of justice but for sheer cheap publicity.


    Arumugam submitted that the petitioner is trying to abuse the process of law and pleased to permit him to intervene in this petition and consequently dismiss the same and render justice. Counsel for Arumugam prayed that the petitioner has no right to include Rajinikanth as accused while filing the petition under 156 (3) The Code of Criminal Procedure.


    Vehemently opposing the intervening plea, Counsel for petitioner D Arun contended that the petition shouldn’t be entertained at this stage. After the arguments from both the counsel, Judge Roslyn Durai adjourned the case to March 10 for the verdict.


    The issue pertains to the petition which was filed by R Umapathy, Secretary of Dravidar Viduthalai Kazhagam, Chennai district. Umapathy submitted that Rajinikanth to score political identity made fraudulent statements to provoke the breach of public peace by promoting enmity and hatred among the people in the name of religion.


    When the petitioner requested legal action against Rajinikanth, Triplicane police officials refused to register the case for the offences under sections 153A, 504 and 505 of the Indian Penal Code on January 18, 2020. Eventually, Umapathy approached the Commissioner of Police who also didn’t take any appropriate action, the petition read.


    Thereafter, the petitioner approached the Madras High Court to direct the police officials to register the case. Dismissing the plea, the court had asked the petitioner to withdraw the petition and follow the due procedure.


    Eventually, the petitioner approached the II Metropolitan Magistrate Court in Egmore on March 7. Counsel for the petitioner D Arun citing various Supreme Court judgements submitted that hate speeches have to be effectively regulated by booking the authors of the hate speeches under the existing penal law.
