TNEB staffer fined for exaggerating complaint

The State Human Rights Commission (SHRC) fined a petitioner of Rs 10,000 for making a false claim and exaggerating his complaint. The petitioner alleged that police officials of Kenikkarai limit in Ramanathapuram had violated his human rights.

The petition was filed by Kandavel who works in TNEB. He claimed that he went to Kenikkarai police station to file a complaint against Sethuraman for allegedly breaking his bike glass on November 4, 2013. “When he went to the police station on November 11, Sub-Inspector K Jayabalan snatched his phone and called Sethuraman to the police station and registered a criminal case against Kandavel. Later, he was remanded in jail,” petition said. After coming out on bail, Kandavel approached SHRC seeking action against the police officials for assaulting and causing injuries. Countering this, Jayabalan and head constables — N Murugan, M Muniasamy and B Palanikumar—denied the allegations. “We arrested him after receiving a complaint from Sethuraman. When he was taken to jail, he said that he was suffering from chest pain. He also rolled on the ground and sustained injuries. He was not tortured and we had not violated the human rights of Kandavel and hence the complaint is liable to be dismissed,” police officials said in their counter. Recording submissions, SHRC Member D Jayachandran held that allegation contained in the complaint was not at all proved and it was filed in order to take vengeance against respondents due to their official actions. Dismissing the complaint with exemplary cost of Rs 10,000, the commission said that Kandavel is not entitled to claim any compensation from police officials.
