Plea to safeguard a neem tree dismissed

Justice RMT Teekaa Raman before whom the plea came said, “As the appropriate authority has already taken steps by registering a CSR, it is open to the petitioner to move the Corporation in view of the alternative remedy available.  Hence, I am not inclined to grant relief as prayed for and the Writ Petition is dismissed.”

The petitioner P Mayur Mehta had alleged that in the platform adjacent to his house, the respondents- Mahendra Kumar and Bangaj Kumar-have laid a cement block affecting the growth of the said neem tree. He sought the court to direct the removal of the cement blocks and restore the neem tree that has been damaged.

His counsel had submitted that without getting proper permission from the Corporation, Mahendra Kumar and Bangaj Kumar cut branches of the neem tree to put up construction in the plot which they had purchased. The said plot is adjacent to the Petitioner’s house and the action of the duo is in violation of the Green Cover order passed by the Corporation, the counsel said.

However, Justice Teekaa Raman dismissed the plea after holding that the petitioner has filed an online complaint to the Corporation Commissioner and CSR No 6 of 2019 was given by the concerned Police Station.
