Ready to grant 10 day parole for Rajiv case convict: Govt

Rajeswari, mother of the detainee, had moved the court seeking a long-term parole until acquittal of all the seven persons. In her petition, which came for hearing before the Division Bench comprising Justices Subbiah and Pugazhenthi, Rajeswari claimed her son, who has earned good conduct during his period of incarceration, has been languishing in prison for a period of 27 years.

Further, the petitioner said she was turning old and at 62 tends to fall sick often. Being alone, it is difficult to manage the family’s property and take care of agriculture, she added.

The State Government had earlier passed a resolution in the assembly to release all seven convicts in the case under Article 161 of the Constitution. Moreover, the government forwarded the resolution copy to Governor Banwarilal Purohit seeking his consent for their release. Purohit is yet to give his nod and the subsequent situation has led to a delay, the petitioner contended. Citing the above, Rajeswari sought a long-term parole for her son until acquittal of all seven convicts.

In response, the State Government’s counsel said: “Since the case is pending with the Governor for his decision, granting long-term parole at this juncture would create a problem. If genuine reasons are cited and petition duly applied, the government is ready to grant a 10–day parole.” After hearing the petition, the judges disposed of the case.
