TTV’s plea challenging re-opening I-T assessments dismissed
The Madras High Court on Friday dismissed the writ petitions filed by Amma Makkal Munnetra Kazhagam (AMMK) leader TTV Dinakaran challenging the re-opening of the assessments by the Income Tax Department for the assessment years 1995-96 and 1996-97 as premature for the court to go into the merits of the case.

Justice SM Subramaniam, who dismissed the petitions said, “The court doesn’t want to go into the merits and demerits of the case and if the court adjudicates the merits and demerits of the case it would only prejudice the investigation of the Income Tax department.”
Referring to the reasons given by the Income Tax Department, the Judge said “It is an admitted fact that searches were made by the Enforcement Department, and some materials were seized. It is alleged that some of the amounts which were invested in the Foreign Countries were not disclosed and cases were already registered under FERA on the basis of which the assessments were re-opened.” However, the Judge, while directing Dinakaran to approach Income Tax authorities to offer his explanations about materials that are alleged to be seized at the time of searches also directed the Income Tax department to afford an opportunity to Dinakaran to explain, so that the long pending litigation gets its logical conclusion.
