Local body elections: Frame charges against those responsible, says DMK
Even as the counsels appearing for the State Government and the Tamil Nadu State Election Commission sought time to make further submissions in the contempt plea against them for failing to hold the local body elections as per the directions by the Madras High Court, the counsel appearing for the DMK insisted that nearly a year and three months have lapsed since they defied the court order and hence the court should allow it to frame charges against them.

When the plea came up for hearing before a division bench of Justice M Sathyanarayanan and Justice M Sundar on Tuesday, Senior Counsel P Wilson appearing for the DMK contended that neither the State nor the election commission was serious about the High Court judgement fixing a time frame to hold the elections.
Noting that while the government has been parading counsels citing amendments and extraneous issues, the senior counsel argued that they still have been unable to explain as to why the court order was not implemented.
Wilson also argued that the contempt plea cannot be kept pending for long and that the SEC is accountable to this court. Seeking to punish them for the gross violation, it was also submitted that the plea seeking to modify the earlier order lacked substance and that the legal disability they claim was brought upon themselves by the impugned ordinance even as the court verdict was to be given the next day.
Even now, all the SEC has to do do is issue a notification announcing the elections and nothing prevented it from doing so. The bench then posted the plea to December 11 for further hearing.
