Nirmala Devi: Committee report to be filed

The Madras High Court on Thursday directed the Madurai Kamaraj University (MKU) administration to file a report as to whether it had formulated Vishaka Committee as per the Sexual Harassment of Women at Workplace (Prevention, Prohibition and Redressal) Act, to hear the alleged sex scandal involving Aruppukottai College Assistant Professor Nirmala Devi.

A division bench comprising Justice M Sathayanarayanan and Justice P Rajamanickam sought a report in this regard by December 12 while hearing an appeal moved by Governor Banwarilal Purohit, as Chancellor of MKU along with the State and CBCID seeking to lift the interim stay on the release of the probe report submitted by the one-man commission headed by retired IAS officer, Santhanam. The interim stay was based on the plea moved by Revolutionary Students Youth Front (RSYF) that the report by the one-man commission if released will influence the CB-CID probe. It had also sought for a probe by a Special Investigation Team (SIT).

However, during the hearing on Thursday, Advocate General Vijay Narayan on submitting a fresh status report told the court that the CBCID probe was progressing in the right direction and since the charge sheet has been filed, the probe report could be released. But the petitioner’s counsel submitted that no enquiry has been held as per the Vishaka guidelines and that alone would bring out the truth behind the audio tapes.

But the bench before seeking the report orally observed that besides the one-man commission, a police enquiry and CBCID probe has transpired and hence further investigation by SIT is not required.
