Bench cynical of state action against hoardings
Close on the heels of Madras High Court Chief Justice Indira Banerjee pulling up the state government over many banners being placed flouting the guidelines during BJP president Amit Shah’s visit, a division bench comprising Justice TS Sivagnanam and Justice Bhavani Subbaroyan on Friday expressed cynicism over the state taking any action on such illegal posters, banners and hoardings.

When a matter related to removal of an unauthorised hoarding came up, the division bench said, “In our considered view, the prayer sought for by the petitioner is not required to be granted, as in several writ petitions the courts have been issuing various directions and the enforcing agency namely the state is unable to enforce the orders for reasons best known.”
“Therefore, such orders issued by this court in all the earlier litigations continue to remain as paper orders. When periodically contempt petitions are filed and despite notices the menace continues,” the bench added.
Interestingly, when the state counsel made a submission that the illegal banners would be removed, Justice Sivagnanam remarked, “Do not make promises for the government in your zeal to argue. They will let you down.”
However, on orally observing that the matter is not about aesthetics, but an issue of safety and nothing is being done about it, the bench held, “Therefore we do not propose to hear the matter.”
The matter is adjourned by two weeks.
