    Teacher convicted of girl’s rape, denied relief

    The Madras High Court has refused to suspend 10 years of rigorous imprisonment (RI) imposed on a teacher who was found guilty of sexually assaulting a 11-year-old female student at a government-run middle school in Thirunallar.

    Justice RMT Teekaa Raman on observing that the petitioner, the accused teacher is handling children and his duty is not only to impart education but also be a role-model to the students, said, “The prosecution witness have given a cogent, unblemished and corroborating evidence, about the act of the accused. 

    Considering the entirety of the circumstances and the evidence placed as noted above by the prosecution witnesses, I am not inclined to grant the relief for the present.” On August 4, 2016 in the class room of Class 6 students, the accused, Sivanesan, a science teacher, with sexual intentions, caused tear injuries thereby committing aggravated sexual assault on the victim. A case was registered under Section 6 of POCSO Act. The prosecution to prove the guilt of the accused person had produced 17 witnesses.

    Thereafter, the trial court on a consideration of the oral and documentary evidence and taking note of the fact that in this case, the accused is a teacher and he has committed the offence on his own student found the teacher guilty and sentenced him to undergo RI for ten years and to pay a fine of Rs 5,000.
