Madras HC: Plea against Rajini turned down

Justice P N Prakash on referring to his earlier order on September 27, 2016 wherein he had clarified that moving the High Court directly for registration of FIR without first approaching the Station House officer, the Superintendent of Police and Magistrate on a complaint is not maintainable, said “In view of the order passed above this petition is not maintainable. However, the petitioner is at liberty to work out his remedy in the manner settled in the above said case by approaching the lower court.” 

The petitioner D Silambarasan of Hosur while citing the press conference of Rajinikanth on his return from Thoothukodi as against the well-established principles of law, said it is pertinent to note that all our constitutional rights have been obtained through peaceful struggle only. But the speech of Rajinikanth is against the rights of those struggling for peoples’ welfare and the comment has been made to defame peaceful strugglers.

He also submitted that he was constrained to approach the High Court since the Inspector of Police, Hosur refused to accept his complaint he had lodged on May 31 in this regard and lack of response on the complaint he had forwarded by registered post to both the Inspector of Police and Superintendent of Police, Krishnagiri District.
