TTV to challenge EC nod for AIADMK amendments
Even while the ruling dispensation welcomed the Election Commission’s stamping on their amended by-law of AIADMK abolishing the party’s general secretary post, the lone contender Amma Makkal Munnetra Kazhagam (AMMK) has decided to rake it up in the judicial fora.
Chennai
Minister for Tamil Official Language K Pandiarajan said the party welcomes the decision of the Election Commission to accept the new posts created and other reorganisations. “Such changes in the organisation were brought in the party in good faith, and the same has been approved by the EC. We welcome it,” he noted. The Minister said the party’s last general body has adopted resolutions creating the posts of Coordinator, Joint-Coordinator and Deputy Coordinators.
He also indicated that several new appointments would be made while the elections would also be held for the party posts soon.
As per the amended party constitution, Rule 20 says the post of General Secretary has been abolished. “As per wishes of the members of the party and the party cadre, Puratchi Thalaivi Dr J Jayalalithaa shall be the eternal General Secretary of the party and no person shall be elected / appointed / nominated to that post,” it reads.
AMMK counsel Raja Senthoor Pandian, referring to the arguments placed before the Delhi High Court, said that their stand was that the Election Commission’s decision to hand over the TwoLeaves symbol to the faction led-by E Madhusoodhanan was flawed.
“With this being the scenario, the EC has decided to fill up the vacuum in their own orders by approving the amendment to the constitution of AIADMK.
The very matter is under litigation as the party general secretary VK Sasikala has contended that she cannot be sacked as the constitution has given all powers to her. There is no room for the ruling dispensation to change the constitution when she is the general secretary,” Raja Senthoor Pandian said.
“The legality of the EC’s decision would be questioned,” he said and added, “This would not have any bearing on the MLAs disqualification case on which the orders have been reserved by the HC We are expecting a positive verdict in that case as well.”
