    Amrutha case: Hospital told to submit report on Jaya’s bio samples

    Even as the Madras High Court has directed Apollo Hospital to submit a report as to whether it has biological samples pertaining to former Chief Minister J Jayalalithaa by Thursday, heated arguments prevailed over the maintainability of the plea moved by one Amrutha claiming to be her daughter.

    Justice S Vaidyanathan before whom the arguments prevailed adjourned the case to June 04 for further hearing after offering the above direction.
    Amrutha had moved the plea seeking to hold an appropriate DNA test to ascertain that she is the daughter of Jayalalithaa and consequently allow her and the family members to cremate the remains of Jayalalithaa as per the rites, rituals and customs of Sri Vaishnava Iyengar Brahmin community.
    When the plea came up on Wednesday, the issue of maintainability of the petition surfaced with counsels appearing for Jayalalithaa’s niece and nephew Deepa Jayakumar and Deepak Jayakumar respectively, saying that the two of them alone are the second-class legal heirs going by the letter offered by Jayalalithaa’s mother.
    It was pointed out by the counsels that Supreme Court in its order while dismissing Amrutha’s petition had clearly stated that she would have to approach an appropriate forum to first establish her claims. Noting that the High court cannot be used to hold a mini trial to first establish that she is the daughter for which no supporting documents have been produced. Advocate Naveen Kumar Murthi moving an impleading plea on behalf of an AIADMK member, contended that the petition was not maintainable as it must be moved in an appropriate civil forum and not in a constitutional court.
    Also, noting that every individual had a right to dignity after death, he said the person, who was silent when Jayalalithaa was alive had come up with such a plea after her death to attain popularity by way of illegal means.
    It is well within the public domain that the late chief minister did not have a marital relationship, nor did she beget any child and Jayalalithaa in various public meetings and party meetings that she does not have any children and the persons belonging to Tamil Nadu are her children, he added.
