Anti-PM stir: Raja moots use of Article 365

On a day when AIADMK party organ ‘Namadhu Amma’ came out with a stinging poem justifying the black flag protests against Prime Minister Narendra Modi, BJP national secretary H Raja warned that the Centre had the option of using Article 365, which allows the Centre to assume itself any of the functions of the state.

The police have identified 750 persons who were responsible for the violent protests and they had filed cases against many of those ‘anti-nationals,’ he said. But, why the government had not arrested them, he asked and demanded that all those involved in anti-national activities should be jailed. He assured that the BJP would protect those in the state who support national unity and integrity.

Raja said it is not necessary for the BJP government to use Article 356, which would result in dismissal of the state government, but it had the option of using Article 365. After the Supreme Court verdict on SR Bommai case, using 356 by the Centre had become almost impossible. As per the Constitution, Article 365 could be evoked by the President on receipt of report of the Governor. It could be proclaimed in a situation in which the government of the state cannot be carried on in accordance with the provisions of the Constitution.

AIADMK leader and Minister D Jayakumar, who spoke to reporters, said violence would not be a solution for any problem and warned that the state government would not give room for violent protests.
