HC refuses to stay party conclave
Observing that the CPI State Conference cannot be injuncted from being conducted at the behest of two individuals, the Madras High Court has dismissed a suit seeking to restrain the party from in any manner proceeding with the meet either from March 28 to 31 or any other date.
Justice CV Karthikeyan on noting that I am not able to convince myself to grant any relief to the plaintiffs who moved the suit, said, “The Constitution of CPI is a comprehensive one giving both rights and duties to the members and the method in which their grievance can be redressed. This court consequently, cannot sit in the armchair of the defendant party and decide the issue.”
The plaintiffs, M Sekar and MK Ramaswamy, had contended that every party member has a right to elect and be elected to party organs and committees while the party had submitted that the plaintiffs are not members of CPI and their membership have not been renewed.
