Dravidian parties can’t monopolise black, red colours, says TTV
No political party can seek monopoly over its flag and in the case of any Dravidian party the colours red and black with or without any other embellishment can never be monopolised, submitted Amma Makkal Munnetra Kazhagam (AMMK) founder and RK Nagar MLA TTV Dhinakaran at the Madras High Court on Tuesday.

Filing a counter to the suit moved by AIADMK joint coordinator and Chief Minister Edappadi K Palaniswami seeking to restrain Dhinakaran from using the flag with black white and red colours, which is like that of AIADMK party flag, he said owing to the goodwill created by the late MGR and Jayalalithaa, the AIADMK party stayed in the minds of the people and not by the flag.
“It is unlikely that the public would associate the AIADMK only with its colors and not to the name of the party or that of MGR and Jayalalithaa,” he added.
Also, referring to a Madras High Court judgment which held that that no legal protection is available to any specimen flag of any registered or unregistered political party against the other, TTV said AIADMK cannot claim any monopoly over the colors red, black and white.
Further submitting that he is entitled to lead the party as he won the RK Nagar bypoll as an independent candidate which vitiates who should actually lead the AIADMK, TTV in his counter said that EPS and OPS are threatened by the goodwill the people of Tamil Nadu had reposed on him which was evinced by his victory in RK Nagar by election.
Noting that the victory in RK Nagar by election clearly reveals that he is the legal heir of AIADMK, TTV sought the court to dismiss the application for injunction.
