‘Table report on assets of mutts and norms for selection of successors’
The Madras High Court, while coming down heavily on the illegal appointment of self-styled godman Nithyananda as Madurai Aadheenam in the first place and his subsequent removal, has directed the Hindu Religious and Charitable Endowment Department (HR&CE) to collect details on the schemes and procedures of mutts in the state in the appointment of successors and the properties vested with them.

Justice Mahadevan while seeking such a report within eight weeks, directed the HR&CE to take steps to nullify any similar trust deeds executed by any ‘madathip athis ’ whereby, under the guise of trust, the administration of the entire properties of the trust is vested with third parties by subverting the provisions of the HR&CE Act.
Observing that it is the duty of the HR&CE to ensure that the properties of all the religious endowments are under protection, the judge said, “In cases, where any spiritual head acts in such a way to bring disrepute to the math or ashram, which he is heading, appropriate action shall be initiated under Section 53 or 59 of the HR & CE Act as the case may be.”
“Self-proclaimed godmen like Nithyananda, who claim to be spiritual gurus initially and later proclaim themselves to be god and, in the process, end up amassing wealth and abusing innocent and vulnerable children and women.”
Justice Mahadevan noted and pointed out that if a person, who is likely to bring disrepute to the mutt because of any of his traits or practices not in line with the procedures and philosophies of the mutt, is appointed, he can be removed or his appointment can be revoked.
