    Conviction of Krishnagiri cop in graft case upheld

    The Madras High Court on Monday upheld the conviction of a Head Constable by the Chief Judicial Magistrate, Krishnagiri, for receiving a bribe of Rs 2,000 from an accused in 2006.

    Justice G Jayachandran on dismissing the appeal filed by G Kandasamy, Head Constable, Bargur in Krishnagiri, challenging the conviction of 2 years Rigorous Imprisonment (RI) and a fine of Rs 1,000 in 2009, said, “The arrest card and the remand report are only make belief documents which have been prepared by the accused only to extort money from the de facto complainant and not to arrest.” 

    Also, on directing the trial court to secure the accused in accordance with law, the judge said, “This court is of the view that the trial court on deep analysis of the evidence and by following the High Court’s judgment as precedent rightly concluded that the tainted money of Rs 2,000 received by the accused is only illegal gratification to do a favour for the complainant by abusing his official position.” 

    As per the case, a tempo driver Paranthaman crashed into a cyclist. But the head constable Kandasamy instead of arresting him demanded a bribe of Rs 5,000. After a bargain, the tempo driver agreed to part with Rs 2,000, which was accepted by Kandasamy. At the time of payment Kandasamy was trapped by the Vigilance and Anti-Corruption Department (V&AC) of Krishnagiri on September 1, 2006. A case was registered and after trial the CJM, Krishnagiri, in 2009 convicted Kandasamy for two years RI and directed him to pay a fine of Rs 1,000. Assailing this order, the head constable moved an appeal in the High Court.
