    Plea on bus strike losses dismissed

    The Madras High Court on Monday dismissed a Public Interest Litigation seeking a direction to the State to recover the loss incurred by it due to the bus strike from the striking employees as utterly ‘misconceived’.

    The first bench comprising Chief Justice Indira Banerjee and Justice Abdul Quddhose before whom the PIL from N Janardhanan and M Muthukumar, both Chennai residents, came up for hearing said, “Whether action should be taken against any employee or whether loss caused to an employer should be recovered from the employee are service matters in respect of which PIL cannot be entertained. PIL is misconceived. Dismissed.” 

    The PIL had contended that if the losses are allowed to be borne by the government or passed on to the public through fare hike and tax, it would set a bad precedent.
