    Petitioner warned of costs for alleging misuse of power by Sasilaka

    The Madras High Court has warned of imposing a cost of Rs 1 lakh on a petitioner who sought the court to direct the police to register an FIR against sidelined AIADMK leader VK Sasikala, for allegedly misusing the constitutional office of former chief minister J Jayalalithaa when she was hospitalised.

    Justice MS Ramesh, before whom a plea moved by K Saravanan of Kancheepuram district came up for hearing on Tuesday, said such petitions are draining quality judicial time of courts and warned of imposing cost if proper explanation is not provided by the petitioner. 

    However, as the petitioner’s counsel sought time to get instructions from his client, the judge adjourned the plea to December 6. 

    Saravanan, in his petition, had submitted that during Jayalalithaa’s hospitalisation, it was only Sasikala, who had total control over the state government, the office of the chief minister and the state police through illegal means. He further submitted that the one-man commission formed to inquire into the circumstances and situation leading to the hospitalisation of the late chief minister on September 22, 2016, and subsequent treatment provided till her demise on December 5, is nothing but a direct admission that the Government of Tamil Nadu was ruled by Sasikala from September 22 to December 5, 2016.

    All instructions, directions regarding the hospitalisation and subsequent treatment and all administrative instructions were received from Sasikala, the petitioner added. 

    Claiming that such illegal acts make out cognizable offence on which the police should have acted upon under section 154(4) of the CrPC, the petitioner wanted the court to direct the authorities to take appropriate action on his complaints. 

    He further noted that on November 26, 2016 he filed a complaint with the Inspector of Police, Thousand Lights station, against Sasikala and Apollo Hospitals on the misuse of constitutional powers and office of Jayalalithaa. But nothing failed to transpire and a similar fate fell on the second complaint on December 13, 2016. The petitioner also claimed that the police replies through RTI revealed that the cops failed to protect the life of former CM as well as failed to act against Sasikala for misuse of power.
