Notice ordered to Speaker and Govt Whip
Even as the opposition DMK has already moved a plea seeking to disqualify the 11 MLAs belonging to the then AIADMK faction led by O Panneersevam under anti-defection law for defying party Whip in the Assembly, the Madras High Court, on Monday, ordered notice to the Assembly Speaker and the Chief Government Whip on a similar plea filed by four MLAs, who are part of the TTV Dinakaran group.

The first bench comprising Chief Justice Indira Banerjee and Justice M Sundar before whom four PILs from MLAs Vetrivel, Rangasamy, Parthiban and Thanga Thamizhselvan seeking to disqualify the MLAs who voted against the present Chief Minister Edappadi K Palaniswami, directed the registry to club the pleas along with that of similar petitions pending adjudication and post it for hearing on November 16.Â
The petitioner while referring to the confidence motion moved by EPS on February 18 submitted that 11 MLAs part of OPS Group, who are had then voted against EPS.
Stating that they have already offered a representation to the Speaker seeking to disqualify the said 11 MLAs on March 20, the Speaker had failed to take any action despite clear cut rules that voting contrary to the direction of the Chief Government Whip attracts disqualification.Â
But notwithstanding this lack of action, the Speaker had taken immediate action on a letter given by the Government Whip to him on August 24 for disqualification of 18 MLAs, who are part of TTV group, for merely giving a letter to the Governor stating lack of confidence in the Chief Ministership of EPS.
