    Chief Secretary, officials summoned in contempt plea

    Holding that the court is not under the Government’s mercy to get its order implemented, the Madras High Court has summoned four top officials of the State including the Chief Secretary Girija Vaidhyanathan to appear before it on Tuesday in a contempt plea pertaining to re-conveyance of land.

    Noting that the present contempt petition pending since 2014 is an example as to how the State is flouting the order passed by the Court by raking up an issue which has attained finality despite dismissal of Special Leave Petitions and related review petitions by the Supreme Court the division bench comprising Justice K K Sasidharan and Justice P Velmurugan also directed Dharmendra Pratap Yadav, the then Secretary, Housing and Urban Development Department, Vijaya Rajkumar, Member Secretary, CMDA, S. Krishnan, Principal Secretary, Housing and Urban Development Department to appear before them. 

    The bench after narrating the affidavit filed before the Court that the order will be complied within three weeks by the Secretary, Housing and Urban Development Department in its order said “But when the contempt petition was taken up the very same Additional Advocate General who earlier made submission before this Court that State would comply with the order directing re-conveyance of the land to the petitioner and who filed an affidavit sworn to by the Secretary to Government, made a “U” turn and submitted that there is no land available for re-conveyance.”
