The government made this submission during the arguments on a petition filed by a Nagercoil resident to establish a JNV in the State. Jeyakumar Thomas of Nagercoil, in his PIL, said that the JNV schools, run by Navodaya Vidyalaya Samiti coming under the MHRD, were fully residential as well as co-education institutions.

The vidyalayas had facility to teach from class 6 to 12 and they are specially tasked to identify talented kids, especially in rural areas. The JNV schools followed a three-language formula, including regional language, English and Hindi. While 600 such schools have been set up across the country, not even one has been established in the state.

Moreover, it is said that the state government was not ready to offer land and building free of cost for the JNV schools and added that when he sent a representation the HRD Minister as well as the Chairman of Navodaya Vidyalaya Samiti replied that the state government has not consented for the implementation. Hence, the petitioner prayed for a direction to open JNV schools one each in every district of Tamil Nadu. After hearing the arguments the judges adjourned the case to June 20.

Based on this statement, a fresh case was filed against Sasikala Pushpa. Following the case Sasikala Pushpa filed a petition at Madurai Bench seeking anticipatory bail.
