The first bench comprising Chief Justice Indira Banerjee and Justice M Sundar, before whom the PIL came up for hearing, also issued notice to the 23 new appointees returnable by July 8.

Advocate VG Natarajan from Serndanur village in Villupuram district who moved the PIL had sought for a direction to the Additional Chief Secretary and Villupuram Collector to redo the whole selection process in a fair, objective and transparent manner in accordance with the dictum laid down by the Apex Court within a time to be fixed by the High Court.

He contended that the 23 persons, having affinity with the party in power, have been appointed as additional public prosecutors and additional government pleaders and other such posts, without considering their ability. He also noted that as per the guideline the District Magistrate in consultation with the Sessions Judge must prepare a panel of names of persons, who are, in his opinion fit to be appointed as Public Prosecutors or Additional Public Prosecutors for the district. But the procedure has not been followed and the appointments have been made arbitrarily, he alleged.
