    Notice issued on fixing of speed governors

    The Madras High Court has issued notice on a plea seeking to declare the Union Ministry of Road Transports and Highways notification, which insists on fixing ‘speed governors’ in four wheeled vehicles, used for carrying passengers, with their seating capacity not exceeding eight, as illegal, invalid, ultra vires and unconstitutional.

    The Division Bench comprising Justice MM Sundresh and Justice R Mahadevan on admitting the petition moved by the Motor Vehicles and Allied Industries Association (MVAIA) directed the Union Ministry of Road Transports and Highways, New Delhi, TN State Secretary, Transport, and Transport Commissioner, Chennai, to file their replies within 2 weeks. 

    MVAIA represented by its secretary K Srinivasan submitted that the transport ministry through a notification dated May 1, 2017, had deleted the exemption granted for these four wheeled vehicles from installing speed governors, when the same is covered under the permit as a transport vehicle, while offering exemption from fixing speed governors to such similar and identical vehicles if they were driven for private use. This notification, he said tantamounts to discrimination between transport vehicles and vehicles used by private owners.
