    Registration of plots as per new rules: High Court

    In a big relief for the real estate sector, the Madras High Court has held that housing plots could be registered strictly in accordance with the new rules framed by the Government viz Tamil Nadu Regularisation of Unapproved Layouts and Plot rules, 2017 and the Tamil Nadu Change of Land Use (From Agriculture to Non-Agriculture purposes in Non-Planning Areas) Rules 2017.

    The first bench comprising Chief Justice Indira Banerjee and Justice M.Sundar passing an interim order in a special sitting on Friday to hear a batch of petitions with regard to conversion of Agricultural lands into housing plots, said “Considering that there is a statutory provision which has now come into force and rules have also been framed by the Govt of Tamil Nadu, we deem it appropriate to direct that plots may be registered strictly in accordance with Section 22-A of Registration Act, 1908, read with the Tamil Nadu Regularization of Unapproved Layouts and Plots Rule, 2017 and the Tamil Nadu Change of Land Use(From Agriculture to Non-Agriculture Purposes in Non-Planning Areas) Rules 2017.” 

    However, the bench stated that the registrations of house plots in unapproved areas after the interim order restraining the registration of such plots by the Court after Sept 9, 2016 until March 28, 2017 and between April 21, 2017 till May 12, 2017 in violation of Court order is prima facie nullity in the eye of  law.
