Moving the bail plea, counsels representing some of the petitioners submitted that their clients were innocent and no way connected to the offence, blaming the police for falsely implicating them. Objecting the bail applications, City Public Prosecutor (CPP) contended that CCTV footage was available to prove the involvement of the petitioners.
Accepting the submission, Judge R Selvakumar said, “Considering the nature of the offence and inhuman act of the petitioners obstructing the burial of the body of the doctor, this court is not inclined to grant bail.”
On April 19, Dr Simon Hercules succumbed to coronavirus infection. The family took his body for burial, they faced still resistance from the residents of TP Chatiram in Kilpauk and Velangadu. “The mob gathered and obstructed the burial. The ambulance in which the body was taken also damaged by the gang.
It is a case of rioting,” the prosecution contended. Anna Nagar and TP Chaitram police checked the CCTV footage and arrested the accused, who were booked under various sections of IPC and Tamil Nadu Property Prevention of Damage and Loss Act.
