In his complaint, buyer R Mithun Chakravarthy, stated that he had booked a unit in a commercial complex ‘Gold Souk Grande’ on GST Road, Vandalur, promoted by Metroline Promoters (P) Ltd, for Rs 37.21 lakh and the date for delivery of the unit was June 30, 2013. But there was a delay and the promoter had promised to pay Rs 31,415 per month as return till the unit was handed over.


The monthly return, however, was paid only for three months and 20 days, said Chakravarthy. On the other hand, the respondent claimed that the Chennai Metropolitan Development Authority (CMDA) took nearly three years to process the renewal of planning permit application.


Following the submissions, TNRERA directed the developer to pay the return for the period between February 2012 and May 2019 which amounted to Rs 27.65 lakh and Rs 2 lakh towards the mental agony, hardship and inconvenience that the buyer faced. Also, the cost towards litigation was fixed at Rs 20,000. The authority also directed the promoter to pay the amount within 30 days.


In two other litigations pertaining to the same project, the TNRERA had earlier directed the promoters to pay Rs 45.36 lakh to buyers A Joesph Stanley and SJS Thamarai Selvi, and Rs 37.25 lakh to Lavanya Prasad.
