Justice M Dhandapani granted the interim stay on a plea moved by a Graduate Nurse Divyabharathi alleging recruitment of nurses who had failed to clear the cut off marks fixed.

She had submitted that TN MRB had come with a recruitment notification on February 7 this year filling up a total of 2,345 vacancies.

Following this, the qualifying exam for the same was held on July 23. Accordingly, the cut off marks for general category, backward class and most backward class was fixed at 64.50 while for scheduled caste and scheduled tribe it was fixed at 64 and 54 per cent respectively.

But contrary to the rules framed, TN MRB is in the process of recruiting as many as 56 nurses who had scored lower than the cut off marks. Moreover, while the exam was held for 2,345 vacancies, TN MRB has now increased the vacancies to 2,580 saying an interim exam was held and has called the 56 persons for certificate verification.

Based on the submissions seeking to stall the recruitment being done contrary to the rules, Justice Dhandapani stayed the recruitment of those who had failed to score the prescribed cut off marks and the process of certificate verification in progress and issuance of appointment orders. The judge also directed the TN MRB to file its replyby October 14.
