The court directed the Commissioner to monitor investigation into the cases registered by the Pallikarani police and the St Thomas Mount police and submit a report on October 15.

A division bench comprising Justice M Sathyanarayanan and Justice N Seshasayee were taking stock of the reports filed by the Corporation and both the police stations related to Subhasri’s death. They directed the additional commissioners responsible for the two police stations to look into the matter and report to the Commissioner.

The bench also asked the Additional Advocate General Elias appearing for the police why even 13 days after the incident, no action has been taken against the AIADMK functionaries Jayagopal and his brother-in-law Meganathan on whose behest the illegal banners were put up.

While the AAG submitted that the accused would be arrested in a short time, the bench sought to know the specific amount of time the police needed and whether the accused have been provided a safe haven.

Senior counsel P Wilson submitted that the police are playing hand-in-glove with the ruling party members and the sections of the IPC in which the accused have been booked does not augur for a proper probe. He, therefore, sought that the case be handed over to the CBI.

The bench appreciated DMK’s move to offer an undertaking that it would detest from putting up such banners, wondered as to why other parties including the ruling one, have not done the same.

    Corporation circular stayed

Meanwhile, while hearing a related plea moved by Mega Digital, the division bench led by Justice Sathyanarayanan granted an interim stay on the circular issued by the Corporation which announced penal action against firms who print banners for those who had failed to get the permissions.
