Justice Krishnan Ramasamy before whom an urgent petition moved by the advocate’s husband TRG Surendar Nair came up, granted the stay as sought for.

Advocate Surendar had submitted that the two students belonging to influential families, might tamper with the evidence if they were let out on bail even before the investigation can be completed.

The counsel appearing for the petitioner also contended that the police had failed to arrest the accused, though the woman advocate had succumbed to the injuries sustained on October 23. Moreover, after their arrest, the accused were taken into police custody for two days–December 20 and 21–and thereafter produced before the lower court, which granted them bail.

With the Additional Public Prosecutor also conceding to the aspect that both the accused might tamper with evidence, Justice Krishnan on being told that the victim’s husband has moved a plea to the High Court seeking transfer of investigation from Pondy Bazaar police officers to some other investigating agency, directed the registry to tag the plea seeking cancellation of bail with the earlier petition and post it before Justice N Anand Venkatesh hearing the case.

It may be noted that Justice Anand Venkatesh while hearing the plea seeking transfer of probe, had slammed the police for the lapses galore in the probe and had also asked for a report from the police byJanuary 7.
