Suit against actor Rajinikanth dismissed
The Madras High Court on Tuesday dismissed a suit filed by film financier Mukunchand Bothra against actor Rajinikanth with a cost of Rs 25,000 to be paid to the actor.

Observing that the suit filed against Rajinikanth is nothing but abuse of process of law to gain cheap publicity and keep the famous person under tenterhook, Justice N. Sathish Kumar said, “If such plaints are not thrown out at the initial stage, it will give license to people one like the plaintiff to approach the Court often even to get cheap publicity.”
The matter relates to Mukunchand Bothra lending Rs 65 lakhs to Kasturi Raja, the fatherin-law of Rajinikanth’s daughter with an assurance that if the amount is not paid by him Rajinikanth will pay. While the financier had already filed a petition before the lower court against the said Kasturi Raja for dishonouring the Cheques issued by him, he filed a civil suit in the Madras High Court seeking for a direction to take against Kasturi Raja, for the misusing his name and in the event of him failing to so, there ought to be a declaration that there is a collusion between them.
Justice N. Sathish Kumar who dismissed the suit filed by the financier in his order said, “Taking action for misusing the names is the choice of the person whose name has been allegedly misused. The Court cannot compel every person to act against somebody who allegedly misused the name which is clearly barred under the Specific Relief Act.” The judge also noted that the entire pleadings of the plaint prima facie shows that the litigation was inspired by vexatious motive and all together groundless.
